Having taken over the defence of three directors involved in proceedings pursuant to Article 2409 of the Italian Civil Code, PedersoliGattai – with a team composed of Filippo Casò (partner) and Debora Monaci (junior partner) – brought an appeal against the decree by which the Court of Milan ordered the directors to bear the costs of the judicial inspection.

The Milan Court of Appeal accepted in full the appeal brought by the directors, stating that judicial inspection costs must always be borne by the suing shareholder, without applying the principle of the unsuccessful party.
