THE ADMINISTRATIVE JUSTICE COUNCIL FOR THE REGION OF SICILY LIFTS THE GENERAL PROHIBITION ON THE TRANSFER OF AUTHORIZATIONS RELATING TO FER PROJECTS BEFORE THEIR COMMISSIONING
With judgments nos. 758-759 published on October 13, 2025, the CGARS rejected the appeals lodged by the Sicilian Region and confirmed the removal from the legal system of Article 4, paragraph 1, letter c) of Decree of the President of the Sicilian Region no. 48/2012 (“The application for the issue of the single authorization pursuant to Article 12 of Legislative Decree No. 387 of December 29, 2003, shall be accompanied, in addition to the documentation listed in point 13.1 of the Ministerial Decree of September 10, 2010, referred to in the introduction, by the following: […]; c) a declaration by which the applicant undertakes to the Administration the obligation to directly construct the plant up to the start-up phase”). In particular, according to the Court, the restriction included in Article 4(1)(c) of Presidential Decree No. 48 of July 18, 2012, has no basis in national energy legislation or in regional legislation governing administrative procedures referred to in Regional Law No. 7 of May 21, 2019, No. 7 of May 21, 2019, and introduces an unjustified restriction in relations between private operators, which is reflected in terms of a violation of the principles of simplification and dissemination of renewable energy sources, as well as a limitation on freedom of establishment and competition.
