Information on the processing of personal data pursuant to EU Regulation No. 679/2016

 

Dear Candidate,

We hereby provide You, pursuant to Article 13 of the General Dat Protection Regulation (the “GDPR” or the “Regulation”), with the following information.

  1. Data Controller and Data Protection Officer

Your personal data will be collected and, in general, processed by Studio Legale PedersoliGattai (the “Firm” or the “Data Controller”), based in Via Principe Amedeo, 5, Milan.

The Firm has appointed a Data Protection Officer (“DPO”) who can be contacted at the email address pedersoligattai.dpo@avvera.it, by post at DPO – Studio Legale PedersoliGattai, Via Principe Amedeo, 5, Milan.

  1. Purpose of processing

Your personal data will be collected through Your curriculum vitae, which You send by regular mail or e-mail or fax or present during an interview, or through recruitment channels (e.g., LinkedIn). The collection and processing of personal data are exclusively aimed at the Firm’s carrying out of activities of research, selection of personnel or collaborators to be included within its organizational structure.

  1. Legal basis, data processing methods and retention periods

The provision of personal data for the purposes referred to in the previous point is optional; however, failure to provide such data will not allow the Firm to consider Your application and to participate in the selection process. The processing of the data is necessary for the possible preparation and execution of an employment or collaboration contract with You (Articles 6(1)(b) of the GDPR and 111-bis of Legislative Decree no. 196/2003, as amended by Legislative Decree no. 101/2018).

It may happen that the curriculum vitae also contains “special categories of personal data[1] . In this case, the Firm may process them only if they are relevant for the purposes of assessing Your professional aptitude and, in any case, within the limits in which the acquisition of such information is strictly necessary for the establishment of the employment or collaboration relationship. The provision of data concerning the state of health may be requested when specifically addressed to searches and selections of personnel belonging to protected categories. To this end, failure to provide such information would make it impossible for the Firm to assess Your professional profile with a view to possible employment or collaboration.

It is understood that the legal basis for the processing of data “belonging to special categories” consists in the fulfilment of obligations attributed to the Data Controller or in the exercise of rights recognized to You, in the field of labour law and social security or protection, pursuant to Article 9(2)(b) of the Regulation, as well as the indications provided by the Authority (e.g., General Authorization No. 1/2016).

Should You provide personal data that are not relevant and/or appropriate – pursuant to applicable legislation (e.g., regulations on protected categories and compulsory recruitment, etc.) – to the selection process, the firm will not process such data and will delete them immediately.

Your personal data will be processed both manually and by computer and electronic means, in a lawful and fair manner, with the help of systems suitable to guarantee the maximum protection of confidentiality and will be updated promptly and constantly. Your personal data will be stored for a period of time not exceeding the achievement of the purposes for which the data are processed.

 

  1. Personal data retention periods

The data will be stored for a maximum period of 12 months from the sending of Your CV or from the date of the last update of the same that You communicated to us. Once this period has expired, the data will be deleted or removed from the Data Controller’s active systems.

 

  1. Recipients and/or categories of recipients to whom personal data may be disclosed

At all times and exclusively for the purposes set out in point 2 above, Your personal data may be communicated to persons and/or categories of persons authorized and specifically instructed by the Firm to carry out processing operations that are strictly indispensable for the purposes set out in this statement, as well as under its direct authority. Finally, we specify that Your personal data shall not be disclosed.

 

  1. Transfer of personal data to a third country

Personal data will not be transferred to countries outside the European Economic Area (EEA).

 

  1. Rights of data subjects

In relation to the processing to which Your personal data will be subjected, You may at any time exercise all the rights provided according to Articles from 15 to 22 and 77 of the GDPR. In particular, You will have the right to:

  1. access to Your personal data and obtain confirmation of the existence or non-existence of Your personal data, their communication in intelligible form, their updating, rectification or, when You are interested, their integration;
  2. obtain the deletion, restriction, transformation into anonymous form or blocking of data processed in breach of the law, including data whose storage is not necessary in relation to the purposes for which the data were collected or subsequently processed;
  3. object, in whole or in part, on legitimate grounds, to the processing of personal data concerning You, even if they are relevant to the purpose of collection;
  4. obtain the transmission of Your data to another data controller (so-called right to data portability).

 

In addition, in accordance with the procedures laid down by the Authority (Garante per la protezione dei dati personali), You may lodge a complaint with the Garante if You consider that the processing concerning you violates the GDPR.

 

[1] Pursuant to Article 9 of the Regulation, ‘special categories of personal data‘ include data capable of revealing ‘racial or ethnic origin, political opinions, religious or philosophical beliefs or trade-union membership‘ as well as ‘genetic data, biometric data capable of uniquely identifying a natural person, data concerning a person’s health or sex life or sexual orientation‘.
